DaCS NOW, LLC Civil and Criminal Subpoena Policy
DaCS NOW's Privacy Policy prohibits the release of user personal or account information without the express permission from the user, except when required by law or to comply with the legal process properly served on DaCS NOW, LLC.
If you require the identity or account information of a DaCS NOW, LLC user in connection with a civil or criminal legal matter you must first fax or mail a valid subpoena.
Submission of Civil and Criminal Subpoenas
DaCS NOW, LLC is located in Hampton Cove, Alabama and all civil and criminal subpoenas should be mailed or faxed to this location:

Upon the receipt of a valid civil or criminal subpoena, DaCS NOW, LLC will immediately notify the user whose information is being requested via email or U.S. mail. In the case of a civil subpoena if the circumstances are not deemed to be an emergency then DaCS NOW, LLC will provide the user an opportunity to resolve the issue or quash the subpoena in court before we submit the information requested by the legal subpoena.
Fees for Civil Subpoena Compliance
DaCS NOW, LLC will charge the user or entity submitting the civil subpoena for administrative costs in complying with the subpoena. The user will have (30) days to submit payment or may be subject to having their account suspended until payment is received.

Administrative Costs:
DaCS NOW, LLC will not produce the content of email per the Electronic Communications Privacy Act, 18 U.S.C. §2701 et seq., which prohibits an electronic communication service provider from producing the contents of electronic communications, even pursuant to subpoena or court order, except in limited circumstances. DaCS NOW, LLC email servers do not retain deleted or sent email. However, we try to maintain temporary records regarding all correspondence with users for up to (30) thirty days. This procedure, however, is not a guarantee.
DaCS NOW, LLC reserves the right to request a copy of the complaint and any supporting documentation that may validate the request and its relation to the pending litigation and the legal subpoena.
